These Terms of Use constitute a legally binding agreement between you (whether an individual or a legal entity, hereinafter "you" or "User") and RealCapital, the entity operating the websites realcapital.ie, realcapital.me, realcapital.sk, realcapital.gr, and realcapital.rs (collectively referred to as the "Site"). Throughout these Terms of Use, RealCapital is referred to as "we," "us," or "our."
The Site functions as a digital marketplace facilitating real estate sales services, including the listing of real estate properties (hereinafter "Marketplace Offerings"). Users are categorized as either:
Sellers: Property owners or authorized agents listing properties on the Site.
Buyers: Individuals or entities interested in purchasing properties.
Sellers and Buyers interact directly regarding all aspects of property transactions, including negotiations, agreements, financing, due diligence, and closings. We are not a real estate agent, broker, or intermediary and do not process payments for property sales—such transactions occur directly between Sellers and Buyers. We are not responsible for the accuracy of information provided by Sellers or for their actions.
By accessing or using the Site and/or Marketplace Offerings, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with these Terms of Use, you are expressly prohibited from using the Site or Marketplace Offerings and must discontinue use immediately.
We may supplement these Terms of Use with additional terms, conditions, or documents posted on the Site, which are incorporated herein by reference. We reserve the right to modify these Terms of Use at our sole discretion. Changes will be indicated by updating the "Last Updated" date above, and your continued use of the Site thereafter constitutes acceptance of the revised terms. You are encouraged to review these Terms periodically.
The Site is intended for users aged 18 or older and is not directed to individuals under 18. Access from jurisdictions where use would violate local laws is at your own risk, and you are responsible for compliance with applicable regulations.
Unless otherwise stated, the Site, Marketplace Offerings, and all associated content—including source code, databases, functionality, software, designs, videos, text, photographs, and graphics (collectively "Content")—as well as trademarks, service marks, and logos (collectively "Marks"), are owned or licensed by us. These are protected under Irish copyright and trademark laws, international conventions, and other intellectual property regulations.
Content and Marks are provided "AS IS" for informational and personal use only. Except as expressly permitted herein, no part of the Site, Marketplace Offerings, Content, or Marks may be copied, reproduced, republished, uploaded, posted, displayed, transmitted, distributed, sold, licensed, or exploited commercially without our prior written consent.
Eligible Users are granted a limited, non-exclusive, revocable license to access and use the Site and download or print Content for personal, non-commercial purposes. All rights not expressly granted are reserved by us.
As an informational service provider, we do not guarantee the safety, effectiveness, accuracy, availability, pricing, ratings, reviews, or legality of Marketplace Offerings or information displayed on the Site. The Site’s content is not a representation to be relied upon, and you agree to hold us harmless from any errors, omissions, or misrepresentations therein. We do not endorse specific Marketplace Offerings; the Site serves solely for informational and promotional purposes.
The Site is accessible to all visitors for viewing Marketplace Offerings without registration. To fully engage with the Marketplace:
Sellers must register at https://board.realcapital.ie.
Buyers may optionally register at https://client.realcapital.ie for enhanced features such as personalized searches, assistance services, and review posting.
We reserve the right to remove or modify usernames deemed inappropriate, obscene, or objectionable. In compliance with data protection laws (e.g., GDPR, CCPA), Users may request deletion of their personal data via account settings or by emailing [email protected].
All property information is provided by Sellers (property owners or their agents). We strive to accurately display prices, videos, photographs, features, and descriptions but do not guarantee their accuracy, completeness, or availability. Marketplace Offerings are subject to change or discontinuation at our discretion without notice. We do not warrant that Offerings will meet your expectations or that errors will be corrected.
The Site does not process financial transactions for property sales; these occur directly between Sellers and Buyers. We are not involved in property transactions as owners, agents, or brokers.

Buyers: Enhanced features are detailed at https://client.realcapital.ie/en/terms-of-service-for-buyers/.
Payments for listing services comply with PCI DSS standards where applicable.
You may only use the Site for its intended purpose. Unauthorized commercial use or activities not endorsed by us are prohibited. You agree not to:
Systematically extract data to create databases without permission.
Defraud, trick, or mislead us or other Users.
Interfere with security features or bypass access restrictions.
Harass, abuse, or harm others using Site-acquired information.
Use the Site unlawfully or upload malicious content (e.g., viruses, spyware).
Engage in automated data collection (e.g., bots, scrapers) beyond standard search engine use.
Reverse-engineer or copy Site software.
Compete with us using Site resources.

Contributions must comply with these Terms and applicable laws.
We may, but are not obligated to:
Monitor the Site for violations.
Take legal action against violators.
Remove or restrict access to inappropriate content.
Manage the Site to ensure proper functioning and protect our rights.
We prioritize data privacy and security. Review our Privacy Policy at https://realcapital.ie/en/privacy-policy/, incorporated herein by reference. The Site is hosted in Germany, and data may be transferred there, subject to GDPR, CCPA, and other applicable laws.
These Terms remain in effect while you use the Site. We may deny access, terminate accounts, or remove content at our discretion, without notice or liability, for any reason, including breaches of these Terms or applicable law. Post-termination, you may not create new accounts under false pretenses.
We may modify or discontinue the Site or Marketplace Offerings at any time without notice or liability. Downtime due to maintenance or technical issues does not obligate us to provide support or compensation.
These Terms are governed by Irish law. Disputes arising hereunder are subject to the exclusive jurisdiction of Irish courts.
Disputes shall be resolved through binding arbitration under the London Court of International Arbitration (LCIA) Rules, with the seat in Dublin, Ireland, conducted in English, unless otherwise agreed.
We may correct errors or update Site information (e.g., pricing, availability) without prior notice.
The Site and Marketplace Offerings are provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for errors, interruptions, or third-party actions.
To the fullest extent permitted by law, we, our directors, and employees are not liable for direct, indirect, consequential, or punitive damages arising from Site use, even if advised of such possibilities.
You agree to indemnify and hold us harmless from claims arising from your use, contributions, breaches of these Terms, or violations of third-party rights, including reasonable legal fees.
Electronic communications and signatures via the Site are legally binding. You consent to receive notices electronically, waiving requirements for non-electronic records unless otherwise required by law.
These Terms, alongside posted policies, form the entire agreement between you and us. Non-enforcement of any provision is not a waiver. Unenforceable provisions are severable without affecting the remainder.
We are not liable for delays or failures due to events beyond our control (e.g., natural disasters, internet outages).
